Virginia is a caveat emptor state regarding buyer rights - "Buyer Beware"
 
 
The Virginia Association of Realtors provide a Standard Agent contract for buyers representation as they also do for listing representation and is the first step that you should review.  Normally agents representing buyers will obtain a contract from their buyers for them to provide access to MLS listings and assistance on the purchase of their home or property.  Not all buyer agents will require a contract from you however it is important to note that fees are normally not charged to the client in lieu of those fees or commissions already having been contracted and paid for by the Seller of the properties listed on MLS.  Participating brokerages through the IDX system and MLS listings provide their LISTED Homes where they represent the Owner/Seller have included in their fee an additional commission fee for the Buyers Broker Agent.  This allows the Listed MLS properties the ability to have set up in advance provisions for the payment to their Listing Agent and also to the Buyers Agent who sells the property, regardless of whether that agent is the Listing agent or Listing broker.  For information on types of agency which by the way is required to be provided to you upon viewing a home by the agent such as at open houses where any substantial information is discussed regarding the property.  It is best that if you are interested in a property to NOT discuss anything with the Listing Agent or their Hosting Agents from the same firm unless you have a direct relationship with that hosting agent and are using them as your agent.  Remember.....how is that listing agent or their associate able to convey to you any real assistance other than first representing the interest of the owner and their desire to sell you the property.  Whether you realize it or not this is even more important when it comes to new developments and new construction in my opinion.
